Terms and Conditions for Online Payments and Credit Card Transactions

1. Acceptance of Terms By using the online payment services provided by Fun Times Hospitality Pty Ltd, Trading as Season & Savour, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, you should refrain from using the payment services.
2. Payment Services We provide an online payment gateway to facilitate the transaction of goods and services. You may make payments using credit cards, debit cards, and other payment methods supported on the platform.
3. Payment Information You agree to provide accurate, current, and complete information when making payments, including your credit card or debit card information, billing address, and any other relevant details. All payment information is processed securely via our third-party payment processor.
4. Authorization and Verification By entering your payment details, you authorize Fun Times Hospitality Pty Ltd, Trading as Season & Savour or its third-party payment processors to charge your card for the amount of your purchase. You may be required to undergo additional verification processes for security purposes.
5. Refunds and Cancellations Refunds and cancellations are handled in accordance with our Refund Policy (which is available separately). You agree to review and accept the terms of our Refund Policy before making any payments.
6. Security We employ industry-standard encryption technologies and secure payment processing systems to ensure the security of your personal and payment information. However, we cannot guarantee that unauthorized access will never occur.
7. Fraud Prevention We take fraud prevention seriously and will work with payment processors to detect and prevent fraudulent transactions. If any fraudulent activity is suspected, your account may be suspended, and the transaction may be cancelled or refunded.
8. Transaction Fees Fun Times Hospitality Pty Ltd, Trading as Season & Savour may charge a transaction fee in addition to the price of the product or service purchased. Any applicable fees will be clearly disclosed during checkout.
9. Limitation of Liability Fun Times Hospitality Pty Ltd, Trading as Season & Savour is not liable for any loss, damage, or inconvenience caused by system failures, payment processing errors, or fraudulent activities. Our total liability for any claim related to the transaction will not exceed the total amount of the transaction.
10. Governing Law These Terms and Conditions are governed by, Consumer protection laws & Payment and data security laws in New South Wales.
Australian Consumer Law (ACL): The ACL, part of the Competition and Consumer Act 2010 (Cth), applies to all businesses in Australia, including food delivery services. It provides protections for consumers, including:
- Right to a refund, repair, or replacement for faulty goods or services.
- Protection against misleading or deceptive conduct.
- Clear labelling and advertising practices.
- If customers experience issues like receiving incorrect food orders, poor quality, or delays in delivery, the ACL outlines their rights to a resolution.
Payment and Data Security Laws
Payment Card Industry Data Security Standard (PCI DSS): If your business processes credit or debit card payments online, you must comply with PCI DSS to ensure secure handling of payment data.
Privacy Act 1988 (Cth) and Australian Privacy Principles (APPs): If your business collects personal information (such as customer names, addresses, and payment details), you must comply with privacy laws to ensure that customer data is handled securely and used only for legitimate purposes.
